Lead Counsel, Litigation Status: Exempt (salaried) Department: LegalPosition SummaryA proactive business and solution-oriented attorney to serve as Lead Counsel to support Plug’s rapid commercial growth and focus on the green hydrogen economy. The Lead Counsel, Litigation will work directly with Plug’s General Counsel and Managing Counsel on all aspects of advising Plug’s leadership team on litigation matters arising from Plug’s business and the international expansion of its products and services. This individual will coordinate across the Company as may be warranted to manage ongoing or emerging litigation risks or support current litigation efforts. This individual must be self-motivated, able to handle multiple competing priorities at once, and is willing to adapt within a dynamic, fast-paced organization. This is a full-time position.Core Duties and ResponsibilitiesAssist the General Counsel and Managing Counsel on all legal aspects of litigation relating to the operation of Plug’s domestic and international business. Advise on strategy and approach to managing litigation risk.Draft, prepare, review, and all necessary litigation documents and materials .Represent Plug in court, where admitted, and in settlement negotiations, where appropriate.Supervise and direct outside counsel on multiple litigation matters.Ensure work product of the highest quality that furthers Plug’s strategic and risk management goals.Open to domestic and international travel as and when required.Represent Plug in a professional manner at all times and in all interactions.Perform all other duties as assigned.Education and ExperienceJ.D. degree (or foreign equivalent) and membership in at least one U.S. state bar.A minimum of ten (10) years’ experience in a law firm, or legal department of a publicly traded corporation, or a combination thereof required.Experience with SEC compliance, shareholder complaints, or class action lawsuits preferred.Experience working directly with business clients, providing day-to-day input on litigation matters, resolving issues that arise in settlement negotiations, and handling pre-litigation legal disputes and inquiries.Strong knowledge of and experience in litigation processes, advocacy, and civil procedure.Self-starting, motivated, assertive, energetic, and creative individual with excellent follow-through capabilities.Demonstratable analytical abilities with strong attention to detail.Superior communication skills.Proficiency with Microsoft Office software..Ability to manage projects and multi-task effectively.Ability to role model high standards of professionalism.Excellent follow-through.
