Affirm is looking for a thoughtful, collaborative, and skilled employment lawyer to join as Senior Counsel, Employment, with primary responsibility for employment legal matters in North America (U.S. and Canada). Reporting to the Associate General Counsel, Employment, you will be an integral member of the Employment Legal team, and in a position to drive impact quickly. What You'll Do
Provide pragmatic advice and guidance on employment matters in the U.S. and Canada, including, but not limited to, wage-and-hour policy implications, reasonable accommodations, employee relations investigations, leaves of absence, incentive compensation plans, employee performance, separations, payroll tax, and employee benefits
Draft and/or review employment agreements, policies, and internal and external communications
Distill complex legal issues into helpful frameworks or reference guides for partners
Collaborate and influence stakeholders through oral and written communications
As needed, negotiate and manage pre-litigation matters, administrative claims, and litigation/arbitration, and outside counsel
Assist with due diligence relating to mergers and acquisitions
Partner with Employee Relations and Ethics teams on investigations, as needed
Monitor legal developments and proactively educate key partners and Employment Legal team
Work on special projects related to employment law, which could include areas outside of main jurisdictions
What We Look For
J.D. from an accredited law school and licensed and in good standing to practice law in at least California or New York or have substantial experience advising/practicing as to California or New York
Minimum of 5 years of relevant legal experience at a leading law firm and/or as in-house counsel
Familiarity with wage-and-hour considerations
Solid knowledge of key U.S. employment laws, including but not limited to, Title VII, ADEA, FCRA (in the employment context), FMLA, ADA, FLSA, EPA, NLRA, and state equivalents
Laser-focus on client-service excellence by being highly proactive, responsive, adaptable, and team-oriented
Demonstrated ability to develop solutions to complex legal matters without losing sight of business objectives
Outstanding organizational skills to handle multiple projects simultaneously and effectively prioritize deadlines
Excellent communication skills and attention to detail
A good sense of humor, personal integrity, and intellectual curiosity
Although Not Required, Experience in These Areas Is Helpful
Working knowledge of key employment laws in Ontario, Canada
Working knowledge of employee benefits considerations, such as ERISA or ACA
Working knowledge of privacy issues that intersect with employment (e.g., CA CCPA)
